1. Agreement to Terms

By accessing or using Whaleal Cart (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access or use the App.

2. Description of Service

Whaleal Cart provides abandoned cart recovery services for Shopify merchants. The App automatically sends recovery emails to customers who abandon their shopping carts, with customizable templates. When discounts are enabled, the App may create time-limited discount codes in the merchant's Shopify store per recipient, according to settings the merchant configures (e.g. percentage or fixed amount).

Service Features:

  • Automated abandoned cart detection
  • Customizable email templates
  • Per-recipient discount code creation in Shopify (when enabled in Settings)
  • Email performance analytics
  • Quota management (200 free emails/month)

3. Account Registration

To use the App, you must have an active Shopify store. By installing the App, you grant Whaleal permission to access your store data necessary for providing the service.

Your Responsibilities:

  • Maintain the security of your Shopify account
  • Ensure you have rights to use all content in your store
  • Comply with all applicable laws and regulations
  • Not use the App for spam or unsolicited commercial emails

4. User Obligations

You agree not to:

  • Use the App to send spam or fraudulent emails
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful or malicious code
  • Attempt to gain unauthorized access to the App
  • Use the App for any illegal or unauthorized purpose
  • Send emails to customers who have unsubscribed

5. Pricing and Payment

Free Tier: 200 emails per month at no cost

Pro Tier: $29.99/month for 2000 emails per cycle (future feature)

Payments are processed through Shopify's billing system. Subscription fees are non-refundable except as required by law.

6. Intellectual Property

The App, including its code, design, and content, is owned by Whaleal and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of data as described in the Privacy Policy.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARTRESCUE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Whaleal from any claims, liabilities, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.

Data Deletion: All your data will be deleted within 30 days of uninstallation.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the "Last Updated" date.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Whaleal operates, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or the App shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved in the courts of the jurisdiction where Whaleal operates.
